How consent validity actually works

Consent validity in India is set by the CPCB categorisation of the unit — red, orange, green or white — which is itself derived from the pollution potential of the industrial activity. Red-category units, being the most polluting, receive the shortest consents and carry the heaviest monitoring load. Green-category units get the longest, which is exactly why green consents are the ones that quietly lapse: five years is remembered, fifteen is not.

Questions about consent expiry

How long is a Consent to Operate valid for?
Validity is driven by the CPCB category of the unit. Red-category units commonly receive around five years, orange around ten and green around fifteen; white-category units generally do not require a Consent to Operate at all. These are the periods typically granted rather than a statutory guarantee — boards differ, and the period stated on your own consent order always governs.
When should I start the renewal process?
At least ninety days before expiry, and earlier if your consent covers many monitoring parameters. You need current lab reports from a NABL-accredited laboratory — commonly within three to six months — plus last year's Form-V filed and any open consent condition closed. Assembling that takes weeks, which is why the calculator works backwards from expiry rather than forwards from today.
What happens if my CTO expires?
Operating without a valid consent is an offence under the Water (Prevention and Control of Pollution) Act 1974 and the Air (Prevention and Control of Pollution) Act 1981. In practice the board can issue a show-cause notice or a closure direction, direct disconnection of power and water supply, and invoke the bank guarantee. Restoring a lapsed consent is materially slower than renewing one on time.

Does this work for CTE and Environmental Clearance too?
The renewal-window logic is the same, but the validity periods are not — a Consent to Establish is tied to project implementation rather than a fixed category period, and an Environmental Clearance carries its own validity and a six-monthly compliance report obligation.
